Amanda Knox Freed, Kercher Family: “We are back to square one.”

The Brother of Meredith Kercher has said that the family accepted the Italian court’s decision to clear Amanda Knox and Raffaele Sollecito of killing his sister Meredith.

Lyle Kercher went on to say that there were now fresh questions about what “truly happened” on the night she was murdered in November 2007.

“While we accept the decision that was handed down yesterday and respect the court and the Italian justice system, we do find that we are now left obviously looking at this again and thinking how a decision that was so certain two years ago has been so emphatically overturned now,” he said.

“If the two released yesterday were not the guilty parties, we are obviously left to wonder who is the other guilty person or people. We are left back at square one.

He, Meredith’s sister Stephanie and her mother Arline had been in court hear the judge’s decision.

After the verdict they held a press conference in Perugia before flying home to the UK.
Stephanie said the court’s decision was “a shock” and that forgiveness was impossible until the family knew what happened.

“It’s very upsetting… We still have no answers. Until the truth comes out, we can’t forgive anyone. No-one has admitted to it,” she said.

She said the “biggest disappointment” was knowing that there was someone else out there who had killed her sister.

“We don’t want the wrong people put away for a crime they didn’t commit,” she said. “It may be a case of waiting another year to get the truth.”

Her mother Arline said what had happened to her daughter was “every parent’s nightmare”.

“We are still absorbing it. You think you have come to a decision and obviously it has been been overturned. I think it is very early days really,” she said.

Meredith’s father John stayed in London, from where he said the court’s decision was “ludicrous” and “crazy”.

John Kercher said the family are “shocked” and were wondering if anyone else would now be brought to justice.

He told the Daily Mirror: “It is ludicrous. How can they ignore all the other evidence?

“I thought the judge might play it safe and uphold the conviction but reduce the sentence. But this result is crazy.

“There were 47 wounds on Meredith and two knives used. One person couldn’t possibly have done that.

“What happens now? Does that mean the police need to look for more killers?”

Stephanie had said on Monday that her sister had been “hugely forgotten” in the furore over the appeal.

Miss Knox and Sollecito had been jailed for 26 years and 25 years, but have now been cleared.

The American has already started her return trip to her hometown of Seattle and was with her parents at an airport on Rome in the last hour.

Rudy Guede, 24, was convicted of the murder and had been jailed for 30 years but his trial concluded he did not act alone and his conviction was upheld on appeal but his sentence reduced to 16 years.

Have You Seen… Five Documentaries To Seek Out (Part Two)

   

This is the second part of my list of five documentaries that I love and hope that you will discover and love too. The first part, in which I lurch from historical curios to sexual fetishes and underground comics, can be found here: Part One.

 

The Sorrow and The Pity (1969)

 

Perhaps due to its appearance as an anti-date movie in Annie Hall, Marcel Ophuls’ The Sorrow and The Pity is often unfairly relegated to the punch line of jokes about gruelling and dull ways to spend an evening. It’s true that Ophuls’ film is a pretty mammoth undertaking but for those willing to persevere it can also be an immensely rewarding one. Filmed in 1969 (although not released until 1981 due to objections from the French government) and clocking in at a mammoth 251 minutes, Le chagrin et la pitié (to give it its French title) is an in-depth look at the behavior of the inhabitants of the French town of Clermont-Ferrand during Nazi occupation.

 

In a sense The Sorrow and the Pity could almost be watched as a companion piece to Albert Camus’

powerful1947 novel La Peste, which deals with the same subject by using disease as a metaphor for occupation and I will admit that having this book in the back of my mind certainly helped me clarify my experience of this gargantuan film. There is a famously enigmatic quote at the end of this novel, ‘What we learn in time of pestilence [is] that there are more things to admire in men than to despise.’ It is The Sorrow and The Pity’s inability to either confirm or deny this statement that makes it so compelling and the audience is forced to try (and fail) to make the moral judgments that the film so stubbornly avoids.

 

     The Sorrow and The Pity is split into two parts. The first of these, entitled The Collapse focuses on the French Resistance and particularly on Pierre Mendès-France, a Jewish political figure who was a key member of this group. The second, entitled The Choice, presents us with the other side of the coin recounting the story of Nazi collaboration particularly that of Christian de la Mazière, a member of the upper classes who fought under the banner of Fascism. As well as these key figures and other well-known persons (including British primeminister Anthony Eden), Ophuls also spoke with the ordinary townspeople who were faced with the impossible choice of collaboration or resistance. This puts a very human face on this grueling situation and by the film’s close you really do feel as if you have lived among these haggard, corrupt, heroic and deeply relatable people in their little town of Clermont-Ferrand. Perhaps the most remarkable and uncomfortable thing about the film is it’s lack of moral judgments particularly given the film’s relative proximity (just over twenty years) to the events it describes. Anthony Eden provides us with perhaps the most useful way of processing this when he states that, ‘One who has not suffered the horrors of an occupying power has no right to judge a nation that has.’ By the end of The Sorrow and The Pity it is impossible to argue with him and we realize that this is perhaps the closest we’ll get to an understanding of Camus’ inscrutable sentiment.

 

The Sorrow and the Pity is currently available on region 2 DVD and is well worth setting aside time to watch.

 

 

Capturing the Friedmans (2004)

 

The Friedmans celebrate during happier times.

Arnold and Elaine Friedman and their three sons were pretty much your archetypal middle class family living in a small town in upstate New York in the 1980s. He was an upbeat and well-liked teacher who ran a computer class out of their basement while she was a hardworking housewife whose rather serious demeanour made her the butt of her husband and three sons’ high-spirited jokes. Like many upwardly mobile families of the period, their favourite pastime was recording their mundane yet happy lives on their personal video camera (a relatively new innovation at this time).  They were content, down to earth and almost aggressively normal, like a Jewish 80s Cleavers. All this came crashing down in November 1987 when their typical suburban house was raided after Arnold was accused of molesting several children in his computer class. Extraordinarily, the family did not give up their beloved hobby and continued to record every tense discussion and blistering argument on videotape as more and more allegations were made, son Jesse was accused and their family began to disintegrate.

The accusations tore the family apart

with the family, police and victims. What makes the films so gripping is that it is cast in the mould of a thriller with each new piece of evidence or witness testimony contradicting something that the audience had earlier been convinced was fact. The result of this is that you are never really sure of anything except the truly subjective nature of truth and, by the film’s close, it is almost impossible to make any definitive judgements about Arnold and, to a larger degree, Jesse’s guilt. This style is undoubtedly effective and makes the film breathtakingly gripping. However, its moral implications have opened it up to some justified criticism and it is hard to watch the film in the same way now that news has emerged that Jarecki (who had previously declared himself to be impartial) actually funded Jesse Friedman’s appeal.

 

What earns Capturing the Friedmans a place on this list though is it’s unique, self-documented insight into a family in turmoil; the way each family member deals with the traumatic events is a master class in psychology and it is staggering to consider why on earth they chose to film themselves going through this horrible ordeal. Elaine Friedman is perhaps the most fascinating character in this respect, the seemingly emotionally fenced-off wife who was oblivious to her husband and son’s crimes. She is also arguably the most sympathetic of the Friedmans and it is heartbreaking to watch as her family continues to favour their father, frequently taking sides against Elaine even after he is prosecuted for the most despicable crimes. A great documentarian will often start with one subject and allow it to develop organically into something entirely different. This is certainly the case with this film, which started out life when Jarecki interviewed son David Friedman, who is a clown by profession, for a documentary he was making on children’s entertainers in New York City. That this light-hearted film spawned  Capturing The Friedmans is as intriguing as it is darkly ironic.

 

Capturing The Friedman’s is currently available on Region 2 DVD and come with a wealth of special features including Jarecki’s ‘Just a Clown’, the documentary on New York clowns that introduced him to David Friedman, and a wealth of documents (including a psychologist’s assessment of the victims) which are provided as DVD-Rom content.

Phone Hacking: Goodman Letter Reveals 'Everyone Knew”

Rupert Murdoch, James Murdoch and Andy Coulson face fresh embarrassment after an explosive letter from former News of the World Royal Correspondent, Clive Goodman was published today.

The four-year-old letter was only published on Tuesday, and it claims that phone hacking was “widely discussed” at editorial meetings at the News of the World until Andy Coulson banned any future references to them.

Goodman went on to claim that Coulson said he could keep his job if he agreed not to implicate the paper in court and that his hacking had “the full knowledge and support” of other senior journalists, who he named.

The Murdochs may now be recalled to parliament to give more evidence in the light of Goodman’s letter. Rupert Murdoch said that Andy Coulson knew nothing about the hacking during the hearing.

The letter was published by the House of Commons Culture, Media and Sport Select Committee. One committee member, the Labour MP Tom Watson, said Goodman’s letter was “absolutely devastating.” He added: “Clive Goodman’s letter is the most significant piece of evidence that has been revealed so far. It completely removes News International’s defence. This is one of the largest cover-ups I have seen in my lifetime.”

Goodman’s letter is dated 2 March 2007, soon after he had served a four-month prison sentence. Addressed to News International’s Director of Human Resources, Daniel Cloke, Goodman writes: “This practice was widely discussed in the daily editorial conference, until explicit reference to it was banned by the editor.” He reveals that the paper’s then lawyer, Tom Crone, knew all the details of the case against him.

In another embarrassing allegation, he adds: “Tom Crone and the editor promised on many occasions that I could come back to a job at the newspaper if I did not implicate the paper or any of its staff in my mitigation plea. I did not, and I expect the paper to honour its promise to me.”

Keith Allen to star with Tara Fitzgerald in BBC One’s new crime drama series The Body Farm

Keith Allen has been cast to star alongside Tara Fitzgerald in BBC One’s new modern crime series The Body Farm. Keith plays Detective Inspector Hale who calls upon Waking the Dead’s pathologist Dr Eve Lockhart (Tara Fitzgerald) and her private forensics facility to help solve crimes and find justice for the victims.

Keith says: “I’m delighted that the BBC has given me the chance to delve into the murky world of The Body Farm”.

In the modern world, private forensics are being used by the law more and more. Eve’s brilliant and ambitious team of scientists turn to police work to pay the bills, but in this team, it’s only Eve who has had any previous experience of dealing with the aftermath of a horrific crime.

Eve’s team is made up of Rosa, Mike and Oggy. Wunmi Mosaku (Moses Jones, Father & Son, Silent Witness) plays Rosa, who is young and eager to put her research into practise, Mark Bazeley (The Queen, The Bourne Ultimatum) plays Mike, Eve’s right-hand man, and Finlay Robertson (How Not to Live Your Life) is Oggy, a hardcore science geek who has had his head buried in his studies so long that he has begun to fear the real world.

Kate Harwood, Controller, Drama Series and Serials, says: “We are tremendously excited to have such a wonderful cast line-up and be following the character of Eve Lockhart into a new job as she leads her pioneering forensic team out to fight crime; Eve will face her challenges in the same way that she did in Waking the Dead, with cool professionalism and quiet compassion.”

We see D.I. Hale introduced to Eve’s team in the opening 90-minute special episode. Viewers are led into their world within the Body Farm, a facility that is pushing back the boundaries of scientific research and solving crimes – it’s unchartered territory. Here no horror is taken for granted and murder is seen to be what it is – visceral and shocking.

Rape: The No Crime Crime?

There are not many subjects that people want to talk about less than rape. It’s never a nice subject and also evokes controversy. But, in my opinion, what is really controversial is how easy it is to get away with. In fact In 1977, according to one report, 30% of rape cases ended in conviction in the UK. Today it is 6%. The plan to grant anonymity to rape suspects was a surprise inclusion in the government’s coalition agreement in May. It seems to have been dropped by the Ministry of Justice, but the fact that such a law was thought up says little about our government’s respect for women who have to endure such an ordeal. The ministry said it had not ruled out anonymity between arrest and charge, something that is more understandable.

It was not in the Conservative or Liberal Democrat election manifestos, although it had been Lib Dem policy since 2006.

The coalition agreement pledged to “extend anonymity in rape cases to defendants”, with ministers stressing the need to “protect anyone who may be wrongly accused from harmful stigma”.

Prime Minister David Cameron appeared to bow to pressure from campaigners when he said he favoured a “limited extension” to the law to cover the period between arrest and charge.

Campaign group Women Against Rape said they were “glad the government has been forced to back down”.

A spokeswoman said: “Why should men accused of rape have special protection not offered to those facing charges of murder, terrorism or child abuse?

“People are no more likely to be falsely accused of rape than of other crimes. Why this attempt to further discredit and discriminate against rape survivors?”

Conservative MP Louise Bagshawe told The Observer that by “singling out rape in this way, ministers are sending a negative signal about women and those who accuse men of rape”.

The Truth is that 1 in 4 women have experienced rape or attempted rape, 95% of cases are never reported, 23% of reported cases are ‘no crime,’ or thrown out, by the police. Over 66% of reported cases never make it to court and the conviction rate is a depressing 6.5% for reported cases. It seems rape is the easiest crime to get away with. Then there is the fact that marital rape in the United Kingdom was only made illegal in 1994. By Michael Howard.

In a recent article in the London’s Evening Standard Met officers repeatedly breached official rules by writing off rape allegations as “no crime” incidents, a Scotland Yard confidential report revealed.

There was also delays in giving victims early specialist assistance, inadequate record-keeping and failure to arrange medical examinations.

The Met said the Sapphire units had now been reorganised and are run by the Yard’s Violent Crime Directorate.

In fact, it was announced in late 2010 that Scotland Yard boosting a specialist sex offences squad in response to a shock rise in rapes reported in London. Rape was up 37 percent in just 12 months.

Police believe much of the increase is due to women becoming more confident in reporting attacks because of a change in tactics in dealing with rapes, rather than a rise in offences.

There has also been a significant increase in “relationship rapes” involving couples. Which are hard to prove. All of this may have something good coming out of it.

There is a newly launched £21.5 million Sapphire unit, with a central command and new intelligence cell, that tackles sex offences across London.

A spokesman said: “The new Sapphire unit is completely victim-based. First of all when victims come forward we believe them and take their allegations seriously. That is our mantra. Secondly we will turn over every stone to get to the bottom of what happened. We have anecdotal evidence from rape crisis centres and havens to say word is getting round that [victims] will be treated with respect and dignity.”

Fact: 17.6 % of women in the United States have survived a completed or attempted rape. Of these, 21.6% were younger than age 12 when they were first raped, and 32.4% were between the ages of 12 and 17. Fact: The FBI estimates that only 37% of all rapes are reported to the police. U.S. Justice Department statistics are even lower, with only 26% of all rapes or attempted rapes being reported to law enforcement officials.

Fact: The National College Women Sexual Victimization Study estimated that between 1 in 4 and 1 in 5 college women experience completed or attempted rape during their college years (Fisher 2000).

Fact: Fewer than half (48%) of all rapes and sexual assaults are reported to the police (DOJ 2001).

Fact: Sexual violence is associated with a host of short- and long-term problems, including physical injury and illness, psychological symptoms, economic costs, and death (National Research Council 1996).

Fact: Rape victims often experience anxiety, guilt, nervousness, phobias, substance abuse, sleep disturbances, depression, alienation, sexual dysfunction, and aggression. They often distrust others and replay the assault in their minds, and they are at increased risk of future victimization (DeLahunta 1997).

Fact: Sexual violence victims exhibit a variety of psychological symptoms that are similar to those of victims of other types of trauma, such as war and natural disaster (National Research Council 1996). A number of long-lasting symptoms and illnesses have been associated with sexual victimization including chronic pelvic pain; premenstrual syndrome; gastrointestinal disorders; and a variety of chronic pain disorders, including headache, back pain, and facial pain (Koss 1992).Between 4% and 30% of rape victims contract sexually transmitted diseases as a result of the victimization (Resnick 1997).

Arguably , no serial Killer has been scrutinized more than Jack the Ripper. It is thought that he was responsible for 5 brutal murders of prostitutes.

For more than 120 years, the identity of the infamous Whitechapel murderer has remained unknown. The programme is good, but it is hard to believe that any human being could be capable of such crimes. I learned more about Jack the Ripper than from anything else I have watched. I highly recommend it. Just don’t watch it alone.
