This Month's Magazines; Jennifer Lopez Believes in Love, 9/11 Anniversary.

Note: Magazines come out a month in advance. September’s magazines are Augusts.

The September issue of Vogue is out and the advertisers have made the issue heavy enough to use as a dumbbell. No complaints from me.

It is the International Collections special and there are lots of clothes to fawn over, Labels and trends to be urban cool, and accessories that make a difference in Vogue’s Big Fashion Issue.

There is a brilliant article on the history of Gucci, Paloma Picasso revisits Venice and talks about her journey to becoming a jewellery designer, Dries Van Noten gives a guide to his Antwerp, up-coming actress, producer and writer Brit Marling is interviewed (Frost loves her), Rifat Ozbek is doing Robin Birley’s new club, Ruperts; Good two page article.

Olivia Wilde talks Haiti and Childhood, there are a lot of autumn clothes that all look too hot, it’s 30c in London at the moment!, Miss V has her excellent social diary, there is a 9 page spread on the turbulent life of John Galliano, Tom Ford on his new cosmetic line and an article on the new David Bailey film. I noticed afterward that in the shops you get a free fashion DVD. However, I did not get this as a subscriber. Bad form.

Emily Mortimer is on the cover of this month’s Tatler and there is an interview inside.

There is a free gift but not for subscribers, grr.

Frost has been complain that Marie Claire has not been giving its subscribers free gifts because of ‘cost’, and this month’s issue came with a free gift. It would seem someone listened but, alas, no. In the shops you get a free nail polish and a conditioner. I just got a conditioner.

Anne Hathaway is on the cover and interviewed inside. Five most common misconceptions about divorce

Couples considering divorce often have a number of misconceptions about the legal process and financial settlement which can cause unnecessary stress. Caroline Bourn, solicitor at Buss Murton Law LLP, Tunbridge Wells has highlighted the five most commonly mentioned by clients to help people keep a sense of perspective on the proceedings.

Caroline Bourn comments: “You would naturally expect clients to have a number of questions about the divorce process but is seems many people confuse what they see or hear in the media. Also people need to make sure they tie up all the loose ends of their divorce as they often don’t realise that there can be ongoing financial responsibilities towards a former spouse.”

1. To allow a divorce to go ahead the Respondent signs the Divorce Petition.

No, when the court sends the Divorce Petition to the Respondent they will also send a blank form called an acknowledgment of service form which should be filled in and returned to the Court within seven days. This form asks specific questions to which the court need answers to be able to grant the divorce – simply signing the petition is not enough.

2. The Decree Nisi brings your marriage to an end.

As reported in the press recently, Liz Hurley’s marriage “ended” in divorce when the Judge pronounced their Decree Nisi. This is not the case, marriage does not end on Decree Nisi, they end on Decree Absolute. The earliest possible date you can apply for Decree Absolute, if you are the Petitioner, is 6 weeks and a day after Decree Nisi. If you are a Respondent it is a further 3 months after the Petitioner could first apply and even then there may be a hearing before a Judge. However, often neither party will apply for Decree Absolute, unless there is an agreement about the finances and that has been known to take years in some cases.

3. You can get a quickie divorce like lots of celebrities seem to do.

Not even the celebrities get quickie divorces, they have to use the same system as the rest of us. Normally, if things go very smoothly, it will take around 6 to 8 weeks from the date the petition is issued by the Court to the date of Decree Nisi and as it will be a minimum of 6 weeks and a day from Decree Nisi before you can apply for Decree Absolute, and even then it may not be in your best interests to be divorced, as you may no longer benefit from death in service and pension benefits and even any inheritance from your ex.

4. Your soon to be ex can put the family home up for sale without your agreement.

Kevin Webster from Coronation Street managed to put the family home up for sale, despite his wife Sally making it clear she did not agree. In the real world any estate agents worth their salt would ensure that all the owners of the property agreed to put the property on the market for sale before marketing the property.

All the legal owners have to sign a contract and a Transfer document and without these a sale could never go through. One person can never force another person to sell a property unless there is a court order which states the property must be sold. Obtaining a Court order is an expensive and often time consuming process and would not be granted without a hearing before a Judge.

5. If you are divorced then your ex can’t make a claim on your money.

If you divorce without sorting out a financial agreement then it does not matter how long ago you divorced, either you or your ex can apply to the court to make a claim. The only bar on this would be that a person who has remarried could not make a claim on an ex, but if you have remarried, and your ex has not then your ex can still make a claim on you. All your assets and to a certain extent those of your new spouse would have to be disclosed to a court and would be considered in any court proceedings.

The only way to avoid this is to have an agreement drawn up which is then approved by a Judge. This document is called a Consent Order and it will contain an agreement that once approved by a Judge is binding upon you and your ex.

If after the divorce you inherit or win the lottery (remember Nigel Page who paid £2million of his Euromillions lottery win to his ex of 10 years last year), then you are safe in the knowledge that your ex can’t make a claim on your money. Once a Court have approved a Consent Order neither party can come back to make a claim on assets, properties or pensions, although if the Consent Order states that maintenance will be paid then the door is left open so that if circumstances change then the maintenance can be varied.

Jennifer Lopez splits from Marc Anthony

Jennifer Lopez and Marc Anthony have split after seven years of marriage.

The couple – who have three-year-old twins, Max and Emme, together – have decided to call time on their relationship after they both agreed on the “difficult decision”.

In a statement released to People magazine, Jennifer and Marc – who wed in June 2004 – said: “We have decided to end our marriage. This was a very difficult decision. We have come to an amicable conclusion on all matters.

“It is a painful time for all involved and we appreciate the respect of our privacy at this time.”

Jennifer – who has been married twice before – recently spoke of her contentment in her personal life now she was a wife and mother.

The 41-year-old beauty said: “I’m in a really happy, good place now, and when you have babies, you feel a different kind of love to anything you’ve experienced – deeper, more profound.

“No matter how much experience you have in love, you’re always learning new things about it; you’re always going to have questions you can never fully answer. I’m probably the happiest I’ve ever been in my life and my husband and my babies have everything to do with that.”

Olivia Wilde 'wobbly' after divorce

Olivia Wilde admits she’s a “little wobbly” following her divorce.

The ‘Cowboys and Aliens’ actress split from her husband Tao Ruspoli in February after eight years of marriage and while she admits it was the right thing to do, she says it’s been a tough time.

The 27-year-old beauty told America’s Marie Claire magazine: “The trauma of the divorce has been humbling. And for the first time, I’m a little wobbly. I’m a case of arrested development, in a way – from spending your 20s with someone who really loves to take care of you, as my husband did.

“But I think it’s very healthy to spend time alone. You need to know how to be alone and not be defined by another person.”

While she still considers Tao a friend, Olivia says it was clear for some time the marriage was going to fail.

She said: “When the relationship becomes about working to make it work, it’s lost that beauty and that optimistic bohemian sense that brought us together

“I kept saying, ‘I failed!’ Admitting that I’m not perfect was a wonderful thing that came out of this,” she said. “There’s this fear that everyone is going to be disappointed in you, but I’m human. I don’t live up to any sort of ideal.

“Even though it didn’t work, there’s nothing I regret about any of it.”

A short marriage, but a longer divorce?

A short marriage often ends with a longer divorce due to differences of opinion over the financial settlement warns Caroline Bourn, solicitor at Buss Murton Law LLP.

Caroline Bourn comments: “This is highlighted by recent media coverage of Katie Price and Alex Reid’s split as reports claim Alex Reid is seeking a £6million divorce settlement, whilst Katie Price is offering £700,000. Couples can have great difficulty in agreeing what is the right settlement when dealing with a short childless marriage where one person brought into the marriage the majority of the wealth.”

“There is no one size fits all approach to any divorce settlement, as each case will depend on its own individual facts and circumstances.”

“In this case, the starting point of any financial agreement will be to identify the “marital acquest”, or more simply, what was built up during the marriage.”

“For example, in Katie Price and Alex Reid’s case this might include the money from the TV shows or magazine deals they were in together. The marital acquest, once identified, is often shared equally, which then leaves the decision as to what should happen to those assets that were bought into the marriage by one party or were inherited or are business assets, which were the result of one party’s effort.”

“In short marriages, contributions made by either party can prove to be decisive; whilst the longer the marriage lasts, the less weight may be given to those contributions made before a marriage.”

“With a short marriage, there is often not the acceptance that the assets will be divided equally, which is often the case in longer marriages.”

“A contested court case will cost thousands of pounds and could take years to conclude and if Katie Price and Alex Reid wish to avoid this, they would be well advised to find a better way of resolving the finances, such as Collaborative Law. This will mean they have to sit down around the same table with their lawyers and thrash the deal out.”

Caroline concludes: “If either party considers remarrying in the future, they would be well advised to draw up a Pre Nuptial Agreement to protect the wealth they bring to the marriage.”
